Miami Workers Compensation Attorney

Being injured at work is both frustrating and unfortunate. Not knowing your rights and responsibilities under the Florida Workers' Compensation Law is even more frustrating. We understand that injured workers often become frustrated with the workers' compensation system because they are uncertain of their rights. Unfortunately, this frustration and stress can hamper recovery from work-related injuries. The Arias Law Group, P.A. is here to answer all of your questions regarding your industrial accident and to help you with your road to recovery.

HOW THE CLAIM’S PROCESS WORKS

A workers’ compensation claim needs to be filed within thirty (30) days of your injury. Within seven (7) days, your employer must report the injury to its insurance carrier. The insurer must send you an informational brochure within three (3) days after receiving this notice. You should then be able to see an approved doctor who will be reimbursed by your employer or by your employer's workers comp carrier. You are also entitled to wages for time lost from work due to disability from your injury. The wage benefit is usually around two-thirds (2/3) of your average weekly wages. Depending on the length of time you are away from work, you may be entitled to wages for the first week away from work. There are many other benefits that are available to injured workers that are often not widely known. Please contact The Arias Law Group, P.A. to learn more about your rights under Florida’s workers’ comp laws.
